Terms & Conditions


 

General

1)   This promotion is run by Zarraffa’s Franchising Pty Ltd (ABN 73 093 874 250) (Zarraffa’s) of 1 / 54 Siganto Drive, Helensvale, Queensland 4212 (Promoter) and its authorised franchisees. A full list of Zarraffa’s authorised franchisees is available on the Promoters website via the following link: <http://www.zarraffas.com/our-stores>.

2)   Entries and information on prizes and how to enter form part of these terms and conditions (Terms). Entries not completed in accordance with these Terms are ineligible. Participation in this promotion constitutes your acceptance of these terms.

3)   This promotion commences on 9 December 2013 and ends at 11:59pm on 2 March 2014 (Promotional Period).


 

Competition Entry / Eligibility

4)   This promotion is only open to residents in the States of Queensland, New South Wales and Western Australia (Eligible Entrants), who:

  • for the Instant Win and Major Prize purchase any size variation of the Promotional Beverage entitled ‘Framboise’ from any Zarraffa’s Coffee store during the Promotional Period (Major Eligible Purchase); and
  • for the exclusive Zarraffa’s Z Card members prizes, purchase any size variation of the Promotional Beverage entitled ‘Framboise’ from any Zarraffa’s Coffee store and use their Zarraffa’s Z Card® with the purchase so that the unique Zarraffa’s Z Card® is recorded with the transaction, during the Promotional Period (Z Promo Eligible Purchase).

5)   Employees and their Immediate Families of the Promoter, authorised franchisees and related entities or bodies corporate of the Promoter are ineligible to enter. For the purposes of this clause “Immediate families” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

6)   For the purpose of these terms and conditions, the promotional drink ‘Framboise’ is referred to as ‘Promotional Beverage’.


 

Minors

7)   Person’s under 18 years of age may only enter this promotion if they have obtained their parent or guardian’s consent to enter this promotion and who’s parent or guardian agrees to be bound by and provide such consents and indemnities as noted in these Terms on their and their minors’ behalf.

8)   If a prize winner is a person under 18 years of age, the prize shall be awarded to their parent or guardian.


 

Promotion Prizes

9)   Every Eligible Entrant who makes a Major Eligible Purchase and Z Promo Eligible Purchase during the Promotional Period will receive one (1) predetermined scratch card (Game Card) for each Promotional Beverage purchased within the Promotional Period. For the avoidance of doubt:

  • where a Promotional Beverage is purchased via the redemption of another offer, including but not limited to the use of a complimentary drink voucher or redemption of Zarraffa’s Z$ from a Zarraffa’s Z Card or an Instant Win Prize in this promotion, that Promotional Beverage is not eligible to receive a Game Card; and
  • where an Eligible Entrant has made a Major Eligible Purchase with their Zarraffa’s Z Card recorded as part of the transaction, the Eligible Entrant will also be eligible for a Z Promo Eligible Purchase; and
  • where an Eligible Entrant has made a Major Eligible Purchase, the Eligible Entrant will also be eligible for a Z Promo Eligible Purchase.

10) Each Game Card will have one (1) scratch panel and a detachable perforated section containing a unique code. Each and every Game Card will have its own unique code.

11) The prizes on offer in this promotion are broken down as:

  • Instant Win Prizes;
  • Major Prize; and
  • Z Promo Prizes.

 

Instant Win Prizes

12) There will be 33,527 Instant Win Prize winners in this promotion that will be decided at random from the Game Cards.

13) All 33,527 Instant Win Prizes to be won shall be distributed to Eligible Entrants via the Game Card.

14) To win an Instant Win Prize, an Eligible Entrant must scratch the instant win game panel on the Game Card (Game Panel).

15) Where the Game Panel is scratched to reveal a depiction noting the particular prize won, being one (1) of those noted below, the Eligible Entrant wins that Instant Win Prize which can be redeemed as described:

  • complimentary upsize on any standard menu item from short to tall or tall to grande, which may be redeemed directly in-store at any Zarraffa’s Coffee store between 9 December 2013 and 2 March 2014 (retail value of each upsize is $1.00 for short to tall and tall to grande. 13,371 to be given away) – upsize to a masai size drink not available; or
  • complimentary ‘extra shot’ of coffee, which is equal to an additional shot of coffee to any drink of purchase, which may be redeemed directly in-store at any Zarraffa’s Coffee store between 9 December 2013 and 2 March 2014 on any purchased beverage (retail value of each complimentary shot is $0.60. 13,371 to be given away); or
  • complimentary tall Promotional Beverage which may be redeemed directly in-store at any Zarraffa’s Coffee store between 9 December 2013 and 2 March 2014 (retail value of each complimentary Promotional Beverage is $5.75 in Metro Queensland, $5.85 in Regional Queensland (being Townsville, Rockhampton and Hervey Bay) and New South Wales and $6.75 in Western Australia. 6,785 to be given away);

16) Where the Game Panel once scratched reveals the word “Sorry, please try again”, the Eligible Entrant has not won an Instant Win Prize in this promotion.

17) The total retail value of the Instant Win prize pool is up to a maximum of $67,192.35 depending on the location of where the Instant Win prizes are redeemed.

18) The Promoter is aware that due to possible printing errors, structural faults or other like events, a situation may arise where claims for Instant Win prizes are received in excess of the advertised number of Instant Win prizes on offer. Accordingly, to address this issue the Promoter shall honour all claims for Instant Win prizes, notwithstanding that the Instant Win prize allocation may be exceeded, subject always to the Promoter confirming that there has been no tampering, forgery, cheating or other form of dishonesty associated with the alleged Game Card. In confirming an alleged Game Card, the Promoter shall not solely base the assessment on printing errors or other quality control issues outside the control of the individual player.

19) As the Promotional Beverage will not be offered for sale from 3 March 2014, between 3 March 2014 and 9 March 2014 (inclusive) a winner of a complimentary Promotional Beverage shall be able to redeem the complimentary Promotional Beverage for a drink of their choosing from the Promoter’s standard menu up to an equal value of the Promotional Beverage previously offered and won under this promotion.

20) The Instant Win Prizes (or any part of the prizes) are not exchangeable or redeemable for cash.

21) Instant Win prizes cannot be redeemed after 11.59pm on 9 March 2014.


 

Z Promo Prize

22) All Z Promo Eligible Purchases throughout the Promotional Period will be automatically entered into the Z Promo Prize Draw, except for those that have been drawn to win a Z Promo Prize.

23) There will be three (3) Z Promo Prize winners in this promotion that will be chosen at random, by an electronic draw system, from all of the Z Promo Prize Entries received by the Promoter during the Promotional Period.

24) There will be three (3) Z Promo Prize draws conducted at the Promoter’s office located at Unit 1 / 54 Siganto Drive, Helensvale, Queensland 4212 at different dates throughout the Promotional Period, as follows:

  • Z Promo Prize Draw 1 – 2.30pm on 2 January 2014 (from those entries received between 9 December 2013 and 11.59pm on 31 December 2013);
  • Z Promo Prize Draw 2 – 2.30pm on 3 February 2014 (from those entries received between 1 January 2014 and 11.59pm on 31 January 2014); and
  • Z Promo Prize Draw 3 – 2.30pm on 4 March 2014 (from those entries received between 1 February 2014 and 11.59pm on 28 February 2014).

25) Each of the three (3) Z Promo Prize winners drawn from the three (3) prize draws will receive a Tangalooma Island Resort Getaway for four (4) people, which includes the following:

  • Four (4) nights accommodation in a resort suite for four (4) guests;
  • A dolphin feeding experience;
  • Buffet breakfast daily;
  • Return launch transfers from Holt Street Wharf, Pinkenba to Tangalooma Island only;
  • A desert safari tour with sand tobogganing; and
  • Access to over 40 complimentary land based activities, such as tours and talks from the Marine Education and Conservation Centre.

The Z Promo Prize does not include:

  • Flights, transfers and/or transport to and from Tangalooma Island Resort and/or the assembly point to enter upon Tangalooma Island Resort (such as Holt Street Wharf, Pinkenba, Qld) from any place in Australia. The Z Promo Prize winner must organise and schedule their own transport and means of travel to and from Tangalooma Island Resort and their cost;
  • Spending money; and
  • Meals and entertainment (other than that specifically stated in these Terms).

Other conditions relating to the Z Promo Prize’s:

  • Each Z Promo Prize is valid for 6 months from the date drawn and must be booked with the Promoter within three (3) months of the Z Promo Prize winner being informed of winning the Z Promo Prize.
  • The room or type of accommodation cannot be changed by the winning Z Promo Prize winners.
  • Each Z Promo Prize winner may be required to provide a credit card upon check-in to cover incidentals such as damage to the accommodation room or use of the mini-bar.
  • not available high season, public holiday weekends, school holidays and days P&O Cruises visit Moreton Island;
  • room availability by the accommodation provider;
  • room allocation policy (if any) of the accommodation provider;
  • being booked via the Promoter, which the Promoter will require at least two (2) week’s advance notice from the Z Promo Prize Winner to book the Z Promo Prize.
  • for conditions and cancellation policies of Tangalooma Island Resort, see http://www.tangalooma.com/info/tangatandcs for full details;
  • cannot be used in conjunction with any other offer at Tangalooma Island Resort and a Z Promo Prize is not valid for conference and event bookings;
  • Dolphin feeding program operates to strict guidelines, the number of guests able to feed the dolphins will depend on weather, tidal conditions and dolphin attendance. Dolphin feeding experience is once per person per stay.

26) The retail value of each Z Promo Prize is a minimum of $2,312.00 and will vary depending on the cost of the accommodation package at the time of booking. As the Z Promo Prize accommodation package noted under clause 25 cannot be changed, the Promoter will not seek any reimbursement from the Z Promo Prize winners for any additional charge due to the time at which the Z Promo Prize is booked within the three (3) months. The total retail prize pool for the Z Promo Prizes is $6,936.00.

27) The Z Promo Prize may be subject to further terms and conditions which are beyond the control of the Promoter and each Z Promo Prize winner must accept those further terms and conditions (if applicable) as a condition of accepting the Z Promo Prize.

28) Any changes to the dates of travel once informed by each Z Promo Prize winner to the Promoter and subsequently booked by the Promoter, will be at the sole cost and expense of the Z Promo Prize Winner.

29) The Z Promo Prizes (or any part of the Z Promo Prizes) are not transferable, exchangeable or redeemable for cash.

30) It is a condition of accepting each Z Promo Prize that any terms and conditions from a third party provided are accepted – subject to the independent review of each winner.

31) A winning Z Promo Prize entry will not eligible for any other Z Promo Prize Draw.

32) Eligible Entrants from one draw are eligible for other draws. For the avoidance of doubt, an Entry submitted before Z Promo Prize Draw 1 will be eligible for all Z Promo Prize draws (unless won), however, an entry submitted after the draw date for Z Promo Prize Draw 2 will only be eligible for Z Promo Prize Draw 3.

33) If a Z Promo Prize or any component of a Z Promo Prize is not available for any reason (including at the time of any redraw), the Promoter in its discretion reserves the right to substitute a Z Promo Prize or any component of a Z Promo Prize with a prize to the equal value and/or specification of the Z Promo Prize in question, subject to any written directions from various lottery departments.

34) The Promoter and its associated and related bodies corporate will not be liable for any damage or delay in transit to prizes. Winners should allow 28 days for delivery of their prize.


 

Z Promo Prize Draw

35) Each Z Promo Prize winner will be notified by phone, email or mail within two (2) working days of the Z Promo Prize draw as noted in clause 24 occurring. The notification may include instructions as to how the winner is to claim the Z Promo Prize and establish his/her entitlement to it. Eligible Entrants may be required to verify their identify as the winner of a Z Promo Prize draw, in accordance with clauses 69 – 72.

36) The names of each Z Promo Prize winner will be published on the Promoter’s website <www.zarraffas.com/framboise>, within two (2) working days of the Z Promo Prize draws occurring.

37) A Z Promo Prize Winner’s details may be published in The Australian and/or any other newspaper if required to comply with various legislation governing this promotion.

38) In the event that a Z Promo Prize is unclaimed by a Z Promo Prize Winner for a period of three (3) months (for any reason), a Z Promo Prize Redraw will be randomly drawn by an electronic draw system by the Promoter, in the following manner:

  • Z Promo Prize Draw 1 – 2.30pm on 2 April 2014 (from those entries received between 9 December 2013 and 11.59pm on 31 December 2013);
  • Z Promo Prize Draw 2 – 2.30pm on 5 May 2014 (from those entries received between 1 January 2014 and 11.59pm on 31 January 2014); and
  • Z Promo Prize Draw 3 – 2.30pm on 4 June 2014 (from those entries received between 1 February 2014 and 11.59pm on 28 February 2014)

In the case of each redraw for a Z Promo Prize, each entry already drawn or previously drawn for any Z Promo Prize, shall be excluded from a subsequent draw.

39) The name of the Z Promo Prize Redraw Winners (if any) will be published on the Promoter’s website <www.zarraffas.com/framboise>, within two (2) working days of the relevant Z Promo Prize Redraw occurring.

40) The Z Promo Prize Redraw Winner’s details may be published in The Australian and/or any other newspaper if required to comply with various legislation governing this promotion.

41) In the event of a Z Promo Prize Redraw for any reason, the Z Promo Prize Redraw Winner acknowledges that as the Z Promo Prize will not be available it shall be substituted with a prize to the equal value and/or specification of the Z Promo Prize, subject to any written directions from various lottery departments.


 

Major Prize Entry

42) To win a Major Prize, an Eligible Entrant must:

  • have completed a Major Eligible Purchase and obtained one (1) Game Card containing a unique code; and
  • on a compatible browser, access the Promoter’s website located at <www.zarraffas.com.au/framboise> and complete the online entry form by entering the unique code from the Game Card and providing the necessary contact information requested, including the Eligible Entrant’s full name, date of birth, address, contact phone number and email address, during the Promotional Period.

(the completion of the above (a) and (b) being considered a Major Prize Entry).

43) Multiple Major Prize Entries are permitted by Eligible Entrants in the Major Prize Draw, subject to the following:

  • each entry must be submitted separately and in accordance with entry requirements;
  • only one unique code per entry is permitted;
  • the same unique code cannot be used more than once; and
  • unrecognised codes will be deemed invalid.

44) Any Major Prize Entry by more than one person (i.e. a joint entry) will be invalid.

45) All Entries for the Major Prize Draw must be received by the Promoter by 11:59pm on Sunday, 2 March 2014.

46) All Entries become the property of the Promoter. No responsibility is accepted for late, lost or misdirected Entries or for any delays or failures in any telecommunications service or equipment.

47) Entries are deemed to be received at the time of receipt into the promotion database and not at the time of transmission by the Eligible Entrant.

48) Eligible Entrants must retain the Game Card, or at a minimum, the perforated section containing the unique code from the Game Card to claim any Major Prize that may be awarded to them, as the Promoter reserves the right to view and inspect the Game Card or the unique codes from the Game Card in accordance with clause 69 – 72 of these Terms.


 

Major Prize Draw

49) There will be one (1) Major Prize winner in this promotion that will be chosen at random, by electronic draw system (Major PrizeWinner).

50) The Major Prize Draw will be conducted at the Promoter’s office located at Unit 1 / 54 Siganto Drive, Helensvale, Queensland 4212 at 3:00pm on 4 March 2014.

51) Eligible Entrants may be required to verify their identify as the winner of the Major Prize Draw, in accordance with clauses 69 – 72.

52) The Major Prize on offer in this promotion, consists of one (1) trip for two (2) people in Port Villa, Vanuatu, which includes the following:

  • Economy class flights for two (2) people, from either Brisbane, Queensland or Perth, Western Australia depending on which city is closest to the Major Prize Draw winner.
  • Four (4) nights accommodation at The Grand Hotel & Casino in Port Vila for a Harbour View Room;
  • Three (3) nights accommodation at White Grass Ocean Resort for a Ocean View Bure.
  • Transfers to and from the airport in Port Vila to the hotel included. Winner must make their own way to and from airport at nearest capital city.
  • Transfer between The Grand Hotel & Casino, Port Vila and White Grass Ocean Resort, Port Vila is included.
  • Breakfast at both The Grand Hotel & Casino and White Grass Ocean Resort for two (2) people included each morning of the stay at the respective hotel.
  • Spending money and entertainment not included.
  • The Major Prize is valid for 6 months from date drawn and must be booked with the Promoter within three (3) months of the Major Prize draw winner being informed of winning the Major Prize.

53) The retail value of the Major Prize is a minimum of $3,704.00 (if travelling from Brisbane) or $4,704.00 (if travelling from Perth) and will vary depending on when the Major Prize winner seeks that the Major Prize is booked.

54) The Major Prize is valid for 12 months from the date of issue and is subject to:

  • room availability by the accommodation providers;
  • room allocation policy (if any) of the accommodation provider; and
  • being booked via the Promoter, which the Promoter will require at least two (2) week’s advance notice from the Major Prize Winner to book the Major Prize.

55) The Major Prize may be subject to further terms and conditions which are beyond the control of the Promoter and the Major Prize Winner must accept those further terms and conditions (if applicable) as a condition of accepting the Major Prize.

56) Any changes to the dates of travel once informed by the Major Prize Winner to the Promoter and subsequently booked by the Promoter, will be at the sole cost and expense of the Major Prize Winner.

57) The Major Prize (or any part of the Major Prize) is not transferable, exchangeable or redeemable for cash.

58) If the Major Prize or any component of the Major Prize is not available for any reason (including at the time of any redraw), the Promoter in its discretion reserves the right to substitute the Major Prize or any component of the Major Prize with a prize to the equal value and/or specification of the Major Prize, subject to any written directions from various lottery departments.

59) The Major Prize Winner will be notified by phone, email or mail within two (2) working days of the Major Prize Draw. The notification may include instructions as to how the winner is to claim the Major Prize and establish his/her entitlement to it.

60) The name of the Major Prize Winner will be published on the Promoter’s website <www.zarraffas.com/macmocha>, within two (2) working days of the Major Prize Draw.

61) The Major Prize Winner’s details may be published in The Australian and/or any other newspaper if required to comply with various legislation governing this promotion.

62) In the event that the Major Prize is unclaimed by the Major Prize Winner for a period of three (3) months (for any reason), a Major Prize Redraw will be randomly drawn by electronic draw system at the Promoter’s office located at Unit 1 / 54 Siganto Drive, Helensvale, Queensland 4212 at 11:00am on 4 June 2014.

63) The Major Prize Redraw will choose one (1) Major Prize Redraw Winner at random, by electronic draw system, from the Eligible Entries received during the Promotion Period, excluding the original Major Prize Winner.


 

Conditions for accepting any Instant Win, Major Prize and Z Promo Prize

64) As a condition of accepting any prize in this promotion, the winners must sign any legal documentation as and in the form required by the Promoter, in their absolute discretion, including but not limited to a statutory declaration confirming their compliance with these terms and eligibility to accept the Prize and/or a legal release and indemnity form.

65) The Promoter’s decision is final and no correspondence will be entered into.

66) The Major Prize and the Z Promo Prizes may be subject to further terms and conditions from third parties, beyond those noted in these terms and conditions, which are outside the control of the Promoter and the winners of the Major Prizes and Z Promo Prize must accept those further terms and conditions (if applicable) as a condition of accepting a Major Prize or the Z Promo Prize.


 

Internet Entries

67) Any costs associated with accessing the promotion website are the responsibility of the Eligible Entrant seeking access and are dependent on the internet service provider used.

68) Eligible Entrants must make their internet entries manually online using a compatible internet browser. The Promoter may reject internet entries if they reasonably form the opinion that they have been entered using automated entry means or by use of a competition entry service.


 

Entry Verification

69) All entries to the promotion may be subject to verification by the Promoter. The Promoter will reimburse an Eligible Entrant for any reasonable costs incurred in complying with this condition. An Eligible Entrant must deliver to the Promoter (by a means determined by the Promoter) copies of any documents the Promoter may request establishing eligibility to enter or win, including evidence of age, residence or identity, the Game Card(s) and/or unique code from the Game Card used to enter the promotion. The Promoter may make one or more requests for such documents. Once the identity of documents available is established, an Eligible Entrant must deliver requested copies within seven (7) days of being asked to do so. At the Promoter’s request, an Eligible Entrant must also, within seven (7) days of being asked, allow the Promoter to inspect and copy the original of any such document.

70) The Promoter may, at their absolute discretion, declare any or all entries made by an Eligible Entrant invalid if the Eligible Entrant:

  • fails to establish their entitlement to enter the promotion to the Promoter’s satisfaction; or
  • produces items that, in the Promoter’s opinion, are illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or
  • in the Promoter’s opinion, tampers with the entry process or benefits from such tampering; or
  • in the Promoter’s opinion, submits an entry which is not in accordance with these terms.

71) Any attempt to cause damage to any website or the information on any website associated with this promotion, otherwise owned or utilised by the Promoter or to otherwise undermine the fair and legitimate operation of this promotion may be a violation of criminal and civil laws. The Promoter reserves the right to seek damages to the fullest extent permitted by law in the event that any such attempt is made, whether or not that attempt results in any such damage, interference or undermining.

72) Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.


 

Privacy

73) Eligible Entrants consent to the Promoter and/or Zarraffa’s using the Eligible Entrant’s name, likeness, image and/or voice in the event they are a winner in this promotion (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

74) The information Eligible Entrants provide will be used by the Promoter and/or Zarraffa’s for the purpose of conducting this promotion, future promotion(s) and for periodically providing Eligible Entrants with marketing information of the Promoters and/or Zarraffa’s products and services, whether by the Promoter, Zarraffa’s and/or its contracted third parties.

75) The Promoter and/or Zarraffa’s may disclose Eligible Entrants’ personal information to its contracted third parties and agents to assist in conducting this promotion, future promotion(s), providing marketing information about the products and services of the Promoter and/or communicating with Eligible Entrants and to State and Territory lottery departments and winners’ names may be published as required under the relevant legislation.

76) As personal information will be submitted and held directly by the Promoter, Eligible Entrants should direct any request to access, update or correct the personal information held by the Promoter by contacting the Promoter at marketing@zarraffas.com. The Promoter will not be responsible or liable for the privacy practices of its contracted third parties.


 

Promoters Liability

77) The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.  Where the operation of this promotion results in, for GST purposes, supplies being made for non-monetary consideration, Eligible Entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

78) The Promoter will not be liable for any loss or damage or for any personal injury sustained as a result of any use of any of the prizes awarded via this promotion, including the Major Prize. To the extent permitted by law, the Promoter is not liable for any loss suffered to person or property by reason of any act or omission, deliberate or negligent, by the Promoter or its employees or agents, in connection with the arrangement for the supply, or the supply, of goods and services by any person to the promotion winners and, where applicable, to any persons accompanying the promotion winners.

79) The Promoter does not take any responsibility for any prize awarded in this promotion from being lost, stolen, damaged, or destroyed in transit to the winner.

80) The Promoter will not be liable for any loss or damage or for any personal injury sustained as a result of taking the prize(s). The Promoter makes no representations or warranties as to the quality, suitability or merchantability of any goods or services offered as prizes. To the extent permitted by law, the Promoter is not liable for any loss suffered to persons or property by reason of any act or omission, deliberate or negligent, by the Promoter or its employees or agents, in connection with the arrangement for the supply, or the supply, of goods and services by any person to the prize winner and, where applicable, to any persons accompanying the prize winner.

81) If for any reason the conduct or operation of this promotion is interfered with or disrupted in any way (including by fraud, unauthorised intervention, vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence this promotion, subject to the approval of any Australian State or Territory Government bodies regulating this promotion.

82) Nothing in these conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act (2010) in Australia, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non- Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of this promotion.

83) To the full extent permitted by law, the Promoter, its associated companies and agencies and all those entities’ personnel (the “Relevant Parties”) exclude all liability for any loss (including any damage, claim, injury, cost or expense) whatsoever, which is suffered or incurred by any Eligible Entrant arising out of or otherwise in connection with this promotion or the prizes awarded in this promotion, including:

  • any indirect, economic or consequential loss;
  • any loss arising from or contributed to by the negligence of a Relevant Party;
  • any liability for personal injury or death; and
  • use of a prize awarded under this promotion.
